By accessing or using merchysmarket.com ("the Site"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Site. These terms apply to all visitors, customers, sellers, and users of the Site.
About Merchy's
Merchy's LLC operates merchysmarket.com, a custom merchandise marketplace based in San Diego, California. We provide custom printing, embroidery, graphic design, and branded merchandise services for businesses and individuals.
Orders and Payment
Custom Orders: All orders placed through Merchy's are custom-made to your specifications. Once you approve your artwork proof and payment is received, your production slot is confirmed and work begins.
Pricing: Prices listed on the Site are in U.S. Dollars (USD). Pricing may vary based on quantity, product selection, print method, and customization requirements. Quotes provided are valid for 30 days unless otherwise stated.
Payment Methods: We accept credit/debit cards, Zelle, PayPal, cash, checks, and Apple Pay. Payment is required before production begins.
No Refunds After Approval: Because all products are custom-made, we do not offer refunds on orders that have been produced according to the approved proof. Please review all proofs carefully before approving. See our Returns and Exchanges policy for details on defective or incorrect orders.
Artwork and Intellectual Property
Your Artwork: By submitting artwork, logos, or designs, you represent that you own the rights to that content or have authorization to use it. Merchy's is not responsible for verifying trademark or copyright ownership of submitted designs.
Our Work: Graphic designs created by the Merchy's design team remain the property of Merchy's LLC until full payment is received, at which point ownership transfers to the customer for the agreed-upon use.
Proofs and Approvals: We provide digital mockups for your approval before production. You are responsible for reviewing spelling, layout, colors, and placement. Once you approve a proof, Merchy's is not liable for errors present in the approved design.
Marketplace and Seller Terms
Seller Accounts: MerchysMarket operates as a marketplace where approved sellers can list and sell products. Sellers are responsible for the accuracy of their product listings and fulfillment of their orders.
Buyer Protection: Orders placed through the marketplace are subject to the same quality standards and return policies as direct Merchy's orders.
Shipping and Delivery
Shipping timelines vary based on production method and destination. Detailed shipping information is available on our Shipping and Delivery page. Merchy's is not responsible for delays caused by shipping carriers, customs processing, or events beyond our control.
Account Responsibilities
If you create an account on the Site, you are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at start@merchysmerch.com if you suspect unauthorized access.
Limitation of Liability
Merchy's LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our services. Our total liability for any claim shall not exceed the amount you paid for the specific order in question.
Prohibited Uses
You may not use the Site to:
- Submit designs containing content that infringes on third-party intellectual property rights
- Submit designs containing illegal, threatening, or harmful content
- Engage in fraudulent transactions or misrepresent your identity
- Interfere with or disrupt the Site's functionality
- Scrape, copy, or redistribute content from the Site without permission
Modifications to Terms
We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of the Site after changes constitutes acceptance of the new terms.
Governing Law
These Terms of Service are governed by the laws of the State of California. Any disputes arising from these terms or your use of the Site shall be resolved in the courts of San Diego County, California.
